Couple claim mobile home loan was predatory

HAMLIN - A predatory lending complaint by Joseph and Jamie Bell revolves around a loan amount allegedly more than twice the value of real property involved.

Bells purchased a 27-year-old single wide mobile home from CMH Homes, Inc., financed by 21st Mortgage Corp. as successor-in-interest to The Home Show-Barboursville, Inc., with Tara Y. Lane handling closing details, the suit says.

The couple, said to be only ninth grade-educated, intended to place the unit next to Jamie's mother's mobile home on a small lot in Hamlin.

Attorney Daniel F. Hedges filed the complaint Nov. 15 in Lincoln Circuit Court. The couple details seven counts of wrongdoing, including Unconscionable Inducement, Illegal Loan, Fraud, Suppressed Defects, Misrepresented Conveyance and Abusive Debt Collection.

Bells discovered numerous defects in the mobile home after making down payments, the complaint says. The loan of $27,280 was significantly more than the real property purchased, considered to be valued at less than $10,000, the complaint says.

The suit asks for jury awards of actual damages, a civil penalty, court expenses and such other equitable and just relief. Trial date is yet to be scheduled in Judge Jay M. Hoke's court.
