Gentner Photo alleges outstanding debt

CHARLESTON – Gentner Photo, LLC, is suing Auge + Gray Collective Works, claiming it owes nearly $10,000 for work performed.

In 2011, the defendant entered into a written contract with Gentner in which Gentner agreed to provide various professional video services, labor and materials for the defendant’s benefit in their development of a video/website project, according to a complaint filed Jan. 17 in Kanawha Circuit Court.

Gentner claims it provided the services, work and materials in accordance with the terms of the contract.

Despite Gentner’s performance pursuant to the terms of the contract, the defendant wrongfully terminated the contract on Feb. 6, and has owed Gentner at least $9,554.18 for work performed up to the date of termination, according to the suit.

Gentner claims the defendant has failed and refused to pay for work performed.

The defendant’s actions are a breach of contract have Auge has been unjustly enriched at Gentner’s expense, according to the suit.

Gentner is seeking damages in the amount of $9,554.18 with interest with pre- and post-judgment interest. It is being represented by Shawn R. Romano and Robert H. Miller II.

The case has been assigned to Circuit Judge Louis H. Bloom.
