Rudd Equipment accused of failing to timely pay final wages

WINFIELD – A former employee is suing Rudd Equipment Company, Inc., for allegedly failing to timely pay his final wages.

In January 2011, Roger D. Keeling resigned from his employment with the defendant, according to a complaint filed Jan. 11 in Putnam Circuit Court.

Keeling claims the defendant failed to pay his final wages no later than the next regular payday following his resignation.

The defendant breached the terms of employment, according to the suit.

Keeling claims because of the breach of the terms of employment, he is entitled to judgment for the wages which remain unpaid through present and for an amount equal to three times the unpaid amount as liquidated damages.

Rudd Equipment’s actions violated West Virginia code, according to the suit.

Keeling is seeking compensatory damages. He is being represented by Thomas H. Peyton.

The case has been assigned to Circuit Judge Joseph K. Reeder.
