SWVA says Elkhart owes nearly $70K for steel products

HUNTINGTON – SWVA, Inc., is suing Elkhart Metal Distributing, Inc., after it claims it owes nearly $70,000 for steel products.

In September and October, Elkhart purchased steel products from SWVA on six different occasions, according to a complaint filed Jan. 23 in Cabell Circuit Court.

SWVA claims Elkhart failed and refused to pay for the steel products.

By not paying SWVA for the goods sold, Elkhart has breached its contracts with SWVA, according to the suit.

SWVA claims Elkhart has caused it to suffer damages in the amount of $69,500.07.

Elkhart has been unjustly enriched at SWVA’s detriment, according to the suit, and is liable to SWVA in the amount of $69,500.07 with interest.

SWVA is seeking damages in the amount of $69,500.07 plus interest with pre- and post-judgment interest. It is being represented by Stephen J. Golder and Arnold J. Janicker.

The case has been assigned to Circuit Judge F. Jane Hustead.
