CHARLESTON – The Charleston law firm of Johnstone & Gabhart is suing Stonegate Construction, Inc., after it claims it has failed to pay for legal services for the last two years.
Karen Hiehle was also named as a defendant in the suit.
The defendants were clients of Johnstone & Gabhart and beginning in 2010, failed and refused to make payments for legal services provided, according to a complaint filed Jan. 14 in Kanawha Circuit Court.
Johnstone & Gabhart claims when the defendants’ account became seriously delinquent and substantial, it contacted the defendants to establish a payment schedule, and while the defendants acknowledged the amount due, they made no effort to satisfy the account.
It was not until Johnstone & Gabhart threatened legal action that some payment was made, according to the suit.
The plaintiff claims despite continuing efforts to recover the amount due, the defendants have continued to fail and refuse to satisfy their legal obligation to pay for legal services.
The defendants have breached their contract with Johnstone & Gabhart and have become unjustly enriched at the law firm’s expense, according to the suit.
The law firm is seeking compensatory damages with pre- and post-judgment interest. It is being represented by Charles M. Johnstone II.
The case has been assigned to Circuit Judge Carrie Webster.
