Woman sues Krispy Kreme for injuries

CHARLESTON - A woman is suing Krispy Kreme Doughnut Corp. after she says she was injured while at its South Charleston location.

On March 17, 2011, Julia Herkert was in the defendant’s restaurant in South Charleston and was exiting the restroom when she slipped and fell on a wet, unmarked floor, according to a complaint filed March 15 in Kanawha Circuit Court.

Herkert claims the defendant failed to mark the area as wet after mopping the area and was negligent, careless and in reckless disregard for the safety of its customers.

As a direct and proximate result of the defendant's negligence, Herkert suffered damages, including medical expenses; pain and suffering; and annoyance and inconvenience, according to the suit.

Herkert is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Vincent J. Smith of Pepper & Nason.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
