West Virginia Steel says Power Plant Services owes more than $80K

CHARLESTON - West Virginia Steel Corporation is suing Power Plant Services Inc. after it allegedly failed to pay more than $80,000 for steel and other products.

Roger Shafer and Paula Shafer were also named as defendants in the suit.

From January through April 2012, the defendants ordered a substantial amount of steel and other products from West Virginia Steel Corporation, according to a complaint filed March 18 in Kanawha Circuit Court.

West Virginia Steel claims the defendants have failed to pay for the products.

The defendants' actions are a breach of contract and have caused West Virginia Steel damages, according to the suit.

West Virginia Steel claims the defendants have been unjustly enriched at its expense.

As a direct and proximate result of the defendants' unjust enrichment, West Virginia Steel has suffered a substantial financial loss, according to the suit.

West Virginia Steel  is seeking judgment in the amount of $84,832.46 with pre- and post-judgment interest. It is being represented by Charles M. Johnstone II and David A. Dobson of Johnstone & Gabhart.

The case has been assigned to Circuit Judge Carrie Webster.
