Man sues St. Mary's Medical Center for father's death

HUNTINGTON - A man is suing St. Mary's Medical Center after he claims it is responsible for his father's death.

Dr. D. Grant Shy and Cardiac Anesthesia Plus Inc. were also named as defendants in the suit.

Gary Lee Fetty was admitted to St. Mary's on March 3, 2011, for purposes of undergoing a surgical procedure consisting of coronary artery bypass grafting and aortic valve replacement, according to a complaint filed April 10 in Cabell Circuit Court.

Nicholas Fetty claims the defendants failed to appropriately follow St. Mary's Open Heart Recovery Room Ventilator Weaning Protocol in prematurely extubating Gary Fetty and in failing to re-establish his airway in a timely fashion, which caused Gary Fetty's death.

As a result of the defendants' deviations from appropriate standards of anesthesia, hospital and nursing care and negligence, according to the suit, Nicholas Fetty claims his father suffered respiratory and cardiac arrest due to a lack of oxygen; suffered severe anoxic brain injury; suffered extreme pain and suffering; suffered a loss of income; and sustained significant additional hospital, medical and other expenses until his death on April 18, 2011.

The defendants' deviations caused the wrongful death of Gary Fetty and caused his estate to incur funeral and burial expenses, according to the suit.

Nicholas Fetty is seeking compensatory damages with pre- and post-judgment interest. He is being represented by William A. Davis.

The case has been assigned to Circuit Judge Paul T. Farrell.
