Man says LTD Financial Services engaged in illegal debt collection

CHARLESTON - A man is suing LTD Financial Services LP for engaging in illegal debt collection and causing him damages.

On July 28, 2011, LTD sent Michael D. McDermott a collection letter, claiming he owed $26,699.19 to United Guaranty Residential, according to a complaint filed May 10 in Kanawha Circuit Court.

McDermott claims on Aug. 12, 2011, his attorney sent LTD a letter disputing the debt and requesting any and all records to verify the debt and justify the collection action.

After this letter, the defendant continued to attempt to contact McDermott by telephone and by mail, according to the suit.

McDermott claims on Feb. 13, LTD sent him another collection letter claiming he owed $27,269.26.

The defendant engaged in illegal debt collection, violated West Virginia code and caused McDermott to suffer damages, according to the suit.

McDermott is seeking compensatory damages and civil penalties. He is being represented by Daniel F. Hedges of Mountain State Justice.

The case has been assigned to Circuit Judge James C. Stucky.
