Man sues Beverly Enterprises, alleges nursing home negligence

CHARLESTON - A Charleston man is suing Beverly Enterprises Inc. after he claims it engaged in nursing home negligence that caused injuries.

Beverly Enterprises-West Virginia Inc., which is doing business as Golden Living Center-Glasgow; Beverly Health & Rehabilitation Services Inc.; GGNSC Glasgow LLC; GGNSC Clinical Services LLC; and Golden Gate National Senior Care LLC were also named as defendants in the suit.

Edward Morton, as power of attorney for Loretta Morton, filed the lawsuit.

Loretta Morton was a nursing home resident of the defendants' nursing facility from July 3, 2010, through July 12, 2012, according to a complaint filed April 5 in Kanawha Circuit Court.

Edward Morton claims the defendants failed to provide the necessary amount of fluid to Loretta Morton so as to prevent dehydration and failed to implement a plan of care to prevent and treat her risk of dehydration.

The defendants failed to provide Loretta Morton with the necessary catheter care and personal care so as to reduce her risk for infections, which resulted in her suffering from urinary tract infections, according to the suit.

Edward Morton claims the defendants are responsible for nursing home abuse Loretta Morton suffered.

As a direct and proximate result of the negligence of the defendants, Loretta Morton sustained bodily injuries, resulting in pain and suffering; mental anguish; inconvenience; physical impairment; loss of capacity to enjoy life; physical defects; and medical expenses, according to the suit.

Edward Morton is seeking compensatory and punitive damages. He is being represented by Andrew L. Paternostro, Sprague W. Hazard and Jeff D. Stewart of the Bell Law Firm.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
