Jackson Co. woman files predatory lending lawsuit

RIPLEY - A Jackson County woman is suing over claims that she fell victim to predatory lending practices.

Jackson County resident Zelta A. Conley filed a lawsuit on July 17 in the Circuit Court of Jackson County against Equity Servicing Corp. and Wells Fargo Bank N.A., citing reckless misrepresentation and fraud.

Conley says she and her late husband purchased a home in 1981, and on Sept. 9, 1999, she entered a 30-year mortgage agreement for $68,400 with an interest rate of 8.400 percent through Equity Servicing Corp., formerly known as TMS Mortgage, doing business as The Money Store.

She claims the defendant relied on a fraudulent appraisal value of $76,000, when her home actually was worth $55,000 at the time, according to the brief.

Conley is seeking reformation of the loan to reflect actual value as well as other relief.

She is being represented by Charleston attorney Lydia Milnes of Mountain State Justice.
