Woman says she broke arm on Spiderman inflatable, sues Italian heritage festival

WHEELING - A Wheeling woman is suing a Georgia business and an Italian heritage festival over claims she was severely injured after falling off an inflatable attraction.

Misty D. Garrison filed a lawsuit on July 16 in the Circuit Court of Ohio County against Robert Holley, dba Simon Says Fun, and the Upper Ohio Valley Italian Heritage Festival Inc., citing negligence and recklessness.

Garrison says she suffered a serious fracture to her right arm on July 24, 2011, when she was helping her young daughter use a Spiderman inflatable.

She claims the defendants were negligent and failed to properly set up and maintain the attraction, which was underinflated, according to the brief.

She is seeking an undetermined amount of damages.

Garrison is being represented by Wheeling attorney Amy Pigg Shafer of Shafer Law Offices.
