Monroe Co. private school facing lawsuit

UNION - A woman is suing after allegedly falling while on bleachers at a private school.

Penny Smith filed a lawsuit Oct. 21 in the Circuit Court of Monroe County against Ballard Christian School, Tommy Raines, Doug Mullins, Eddie Lankford, Harry Mann and Charlie Pitzer in their capacities as trustees for Ballard Baptist Church; David Spencer, individually and as an agent of Ballard Christian School; Phil Spencer, individually and as an agent of Ballard Christian School; and Ballard Baptist Church, doing business as Ballard Christian School, citing negligence.

The plaintiff alleges on Oct. 22, 2011, she sustained serious injuries when she fell while on the bleachers in the gymnasium at Ballard Christian School in Monroe County.

According to the complaint, Phil Spencer suddenly and negligently turned the lights off in the gymnasium, making it impossible to see, causing the plaintiff to fall.

The plaintiff is seeking an undisclosed amount in damages. She is being represented by Randall L. Veneri of Veneri Law Offices in Princeton.
