Daily Express sued over Taylor County car wreck

CLARKSBURG - A carrier company and employee face suit after a man was allegedly injured in a vehicle accident.

Ahmad S. Tajwall filed a lawsuit Aug. 7 in the Circuit Court of Taylor County against Daily Express Inc. and Gustav Gerstle III, citing negligence and respondeat superior. It has since been removed to federal court.

According to the complaint on Sept. 1, 2011, Tajwall and Gerstle were involved in a motor vehicle accident on U.S. Route 50 near Pruntytown.

The plaintiff contends at the time of the accident, Gerstle was employed by Daily Express when he attempted to make a left hand turn and lost control of the trailer, causing it to strike the plaintiff's vehicle.

As a result of the accident, the plaintiff sustained serious injuries, including traumatic brain injury and was trapped in his vehicle, according to the complaint.

Tajwall is seeking an undisclosed amount in damages. He is being represented in the case by T. Keith Gould of The Miley Legal Group.

The defendants removed the case to U.S. District Court for the Northern District of West Virginia on Oct. 31.

The removal notice says the plaintiff is of Wetzel County and Daily Express has a principal place of business in Pennsylvania. It adds that Gerstle is a resident of Florida.

Daily Express is represented by Timothy Smith of Pion, Nerone, Girman, Winslow & Smith in Pittsburgh.
