Woman sues Holiday Inn for wage payment violations

HUNTINGTON – A woman is suing Holiday Inn Hotel & Suites after she claims it violated the West Virginia Wage Payment and Collection Act.

Uptowner Inns Inc. is doing business as Holiday Inn Hotel & Suites.

Amy R. Fletcher was employed by the defendant as a waitress until she was terminated on May 1, 2012, according to a complaint filed in Cabell Circuit Court.

Fletcher claims the defendant was obligated to pay its employees pursuant to the West Virginia Wage Payment and Collection Act.

Consistent with the defendant's pay practices, it failed to pay Fletcher all her employment wages due within the time period mandated by the WPCA, according to the suit.

Fletcher claims the defendant did not pay her final wages until May 5, 2012.

Fletcher is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Todd S. Bailess and Joy B. Mega of Bailess Law PLLC.

The case is assigned to Circuit Judge F. Jane Hustead.
