Tire and auto shop targeted for alleged ex-employee payment violations

WHEELING -- Former employees of a tire and auto repair franchise are suing over being allegedly terminated then having their pay withheld for too long.

Dewey M. Noble II and others filed a class action complaint June 1 in Ohio Circuit Court against Bridgestone Retail Operations LLC, doing business as Expert Tire, Firestone C and F, Firestone Complete Auto Care, Firestone Tire and Service Center, and GCR Truck Tire Center.

Noble worked for the defendant until being terminated on June 8, 2011. The rest of the plaintiffs are all those also terminated in recent years by the defendant.

"Consistent with the defendant's pay practices," the lawsuit states, "defendant failed to pay plaintiff all his employment wages due within the time period mandated" by the Wage Payment and Collection Act. Noble didn't receive all the rest of his wages until Aug. 19, 2011, the lawsuit states.

The plaintiffs are asking the court to certify this case as an official class action and to award the named plaintiff no more than $75,000, as well as to award the class unspecified damages, pre- and post-judgment interest, attorneys' fees and court costs.

The plaintiff is represented by Todd S. Bailess and Joy B. Mega of Bailess Law PLLC, as well as Rodney A. Smith, Jonathan R. Marshall and Tony L. Clackler II of Bailey and Glasser LLP, all of Charleston.
