CHARLESTON--A Kanawha County widow is suing a Charleston medical facility seeking punitive damages in the alleged wrongful death of her husband.
Violet Moore, as personal representative for the estate of Aaron Moore, filed a lawsuit July 13 in Kanawha Circuit Court, against Charleston Area Medical Center Inc., of Charleston, alleging negligence, reckless misconduct and wrongful death.
According to the complaint, Violet Moore's husband, Aaron Moore, was a patient at the Charleston Area Medical Center from June 3-19, 2014, where he was admitted and treated for an electrolyte imbalance and hypotension. While there, the suit says, Moore fell and suffered a left hip fracture.
Violet Moore alleges CAMC's negligence and carelessness contributed substantially to Moore's harm, injury and subsequent death. The suit says the medical center failed to provide proper training for their employees and a safe living environment for her late husband.
Moore seeks all damages allowable under state law, attorney fees and punitive damages, as well as other costs the court sees fit to include, and a jury trial. She is represented by attorneys Andrew L. Paternostro and Jeff D. Stewart, of The Bell Law Firm in Charleston. The case has been assigned to Circuit Judge James Stucky.
