Bank sues Upper Kanawha Valley Development Corp. over allegedly failing to pay off loan

CHARLESTON – A bank is suing a Kanawha County company for failing to pay off the remainder of half-million dollar loan.

Wesbanco Bank Inc. filed a lawsuit Aug. 7 in Kanawha Circuit Court against Upper Kanawha Valley Development Corp. and John H. Wellford III, claiming the defendants defaulted on a bank note.

Wesbanco claims on April 2, 2002, the company entered into a note agreement in the amount of $500,000 to be paid off in installments. Wesbanco alleges the company has failed to finish off its payments and has incurred interest on its debt.

Wesbanco is seeking the remainder due of $42,753.55, as well as interest accrued, plus attorney's fees and costs as provided in the note, amended and restated note, and guaranty agreement, and post-judgment interest. Wesbanco is represented by Thomas H. Ewing of Kay Casto & Chaney PLLC in Fayetteville.
