Morgan's Food and Spirits, individuals sued after alleged assault

BECKLEY – A Raleigh County man who was allegedly assaulted by two intoxicated individuals is suing the company that sold the assailants the alcohol, the assailants, and others.

Eric B. Shuck filed suit on Oct. 9 in the Raleigh Circuit Court against Terry Simmons Jr., Bibad Rijal, the Beckley Hotel Associates, BHA Inc., doing business as Morgan's Food and Spirits, Stephney Pettry and others, citing assault, failure to protect, and unlawfully selling liquor to intoxicated persons.

The plaintiff alleges that on Oct.. 11, 2014, he suffered injuries to his mouth, teeth, shoulder and ribs when he was attacked by defendants Bibal and Simmons after they were sold alcohol by defendant, Morgan's Food and Spirits, while intoxicated. Pettry is the general manager of Morgan's Food and Spirits.

The plaintiff seeks compensatory damages for medical expenses and lost wages, plus punitive damages. He is represented by Robert Dunlap of Beckley.
