Custom Business Solutions claims Appalachian Eyes did not pay for services

BECKLEY – A Raleigh County business solutions company is suing an optometry center and one of its optometrists because they allegedly did not pay for services provided.

Custom Business Solutions filed a lawsuit Oct. 25 in Raleigh Circuit Court against Appalachian Eyes and Gregory S. Moore, alleging breach of contract and unjust enrichment.

On Oct. 1, 2014, the suit states, the parties entered into a professional employment agreement wherein Custom Business Solutions would provide certain services to Appalachian Eyes.

Custom Business Solutions billed and invoiced Appalachian Eyes for the services it provided and Moore personally guaranteed payment for those services, but the suit states Appalachian Eyes has failed to pay the amounts due.

As of July 3, Appalachian Eyes is indebted to Custom Business Services in the amount of $39,061.80.

Custom Business Solutions seeks to recover the amount owed, plus interests, attorney fees, and other costs of the suit.

The plaintiff is represented by attorney Gregory W. Sproles of Summersville. The case has been assigned to Circuit Judge John A. Hutchison.
