Worker accuses Brake Supply Co. of negligence, retaliation

BECKLEY – A Raleigh County man says negligence on the part of his employer, Brake Supply Co., cost him three fingers on his left hand.

Frederick Smith III filed a lawsuit Nov. 30 in Raleigh Circuit Court against Brake Supply Co. Inc., alleging liability for personal injury and retaliation for a workers' compensation claim.

According to the complaint, Smith suffered the hand injury Nov. 22, 2014, while he was working for Brake Supply Co. Smith claims his employer’s negligence was intentional, reckless and malicious, and that after filing a workers' compensation claim, he was forced to transfer to other locations and ultimately fired.

Smith seeks compensatory and punitive damages in an amount to be determined at a jury trial. He is represented by Fayetteville attorney Greg A. Hewitt. The case has been assigned to Circuit Judge John A. Hutchison.
