Injured driver seeks restitution after West Union collision

WEST UNION – A Doddridge County man is suing a truck driver after a collision on Big Flint Road.

Johnie Lee Johnson Jr. filed the suit Dec. 21 in Doddridge Circuit Court against Multi-Chem Group and Richard Noel Cerciello, citing negligence and reckless conduct.

According to the complaint, on Jan. 14, 2014, the plaintiff was driving south on Big Flint Road near West Union. At the same time, Cerciello was driving a tractor-trailer, owned by Multi-Chem, north on the same roadway.

As both parties approached a bend in the road, Cerciello caused the trailer he was towing to cross the center line and strike the plaintiff's vehicle, the suit states. The plaintiff's injuries have resulted in damages such as medical expenses, pain and suffering, diminished capacity to enjoy life and physical limitations.

Johnson seeks from both defendants compensatory damages in an amount to be determined by a jury, punitive damages, interest, attorney fees and court costs. He is represented by Stephen B. Farmer and Eric M. Hayhurst of Farmer, Cline & Campbell of Morgantown. The case is assigned to Judge Timothy Sweeney.
