Rabel Development blamed for flood damage to woman's home

CHARLESTON — A woman is suing a development company over damages caused by a flood, and the allegedly negligence of the corporation to repair and prevent such problems.

Joyce Elswick filed a complaint on Dec. 17 in the Kanawha Circuit Court against Rabel Development LLC alleging negligence and unreasonableness in preparation and construction.

The plaintiff's home suffered damage during a flood. She alleges that although the defendant attempted to repair and maintain the road conditions for flood and storm damages near her home, the company failed to perform erosion control and other duties as it should have. The plaintiff alleges that it was unreasonable and negligent of the company to act in the way that it did, and connects the damage of her home to the company's actions.

Elswick is seeking compensation for all damages suffered and legal fees incurred. She is represented by Stuart Calwell of The Calwell Practice PLLC in Charleston.
