GLENVILLE - A Gilmer County man is suing a car dealership over allegations it sold him a defective car.
Wilber Ball filed suit against Mid-State Automotive Inc., Ally Financial Inc. and General Motors LLC on Jan. 8 in Gilmer Circuit Court, citing breach of express warranty, breach of implied warranty of merchantability, breach of implied warranty of fitness and other counts.
According to the complaint, Ball purchased a new 2014 Chevrolet Cruze in July 2014 and had traded in a 2008 Chevy Colorado truck that was, according to the plaintiff, in working condition. This purchase included a warranty and express warranty from the manufacturer, the complaint states. Ball alleges that following the purchase the vehicle began to exhibit functional problems that impaired the usability and safety of the car. The heating system became defective in February and shifting and acceleration problems began in July, the plaintiff states. The plaintiff also reports that the vehicle has had ants within its interior since its purchase.
Ball seeks rescission of the contract, damages in an amount to be determined at trial and costs and attorney's fees. He is represented by Sara Bird of Mountain State Justice Inc.
