Huntington's Healthsouth Rehabilitation Hospital facing negligence suit

HUNTINGTON—A Kanawha County man is blaming a rehab center for his brother’s death, saying its alleged abuse and neglect contributed to his demise.

Joseph Spencer, personal representative of the estate of Jamie Spencer, filed a lawsuit on Dec. 23, 2015 in Cabell Circuit Court against Rebound LLC, doing business as Healthsouth Rehabilitation Hospital of Huntington and Healthsouth Corporation, claiming the rehab center failed to provide proper care for Jamie.

The plaintiff alleges that Jamie Spencer, who was admitted to the rehab center on June 23, 2014 through July 9, 2014, not only suffered from multiple falls and injuries but sustained acute renal failure after the center allegedly failed to provide adequate fluid to prevent dehydration. Jamie Spencer died on July 19, 2014.

Joseph Spencer argues that the defendant acted negligently and carelessly, which contributed substantially to serious injuries to Jamie that ultimately resulted in his death. The plaintiff asserts that the defendants breached its duty to Jamie and as such caused his passing, and also mental and emotional anguish to the plaintiff. The estate has also allegedly incurred multiple costs including medical and funeral expenses.

The plaintiff is suing for an undisclosed amount of damages, punitive damages, attorney’s fees and any other rewards deemed just by the court. He is represented by Andrew L. Paternostro and Jeff D. Stewart of The Bell Law Firm PLLC in Charleston.
