Woman sues Atkins & Ogle Law Offices for consumer credit violations

BECKLEY – A woman is suing Atkins & Ogle Law Offices LC after she claims it violated her privacy and the West Virginia Consumer Credit and Protection Act.

Linda Snuffer became in arrears upon an alleged debt to Barclays Bank Delaware, and A&O began to engage in collection of the indebtedness through telephone calls, according to a complaint filed Jan. 12 in Raleigh Circuit Court.

On Aug. 11, 2012, a collector employed by A&O telephoned Snuffer as her home and spoke with her husband, who advised the collector that the plaintiff was represented by an attorney in connection with the Barclays debt and provided the attorney’s name and correct telephone number.

Snuffer claims on Aug. 13, 2012, an A&O employee telephoned her attorney and the attorney confirmed that their law office was representing Snuffer in connection with all of her and her husband’s debts.

Later that day, and on multiple occasions, A&O called Snuffer’s house again regarding the debt, according to the suit.

Snuffer claims the defendant violated the West Virginia Consumer Credit and Protection Act and its actions were a common law invasion of privacy.

Snuffer is seeking compensatory and punitive damages. She is being represented by Ralph C. Young, Christopher B. Frost, Steven R. Broadwater Jr. and Jed R. Nolan of Hamilton, Burgess, Young & Pollard PLLC.

Atkins & Ogle was previously sued in Raleigh Circuit Court for similar claims back in June. The same attorneys represented the plaintiff in that lawsuit.
