Man claims brain injury after falling on ice at Pizza Station

ST. MARYS – A man who slipped and fell on ice outside of a pizza restaurant claims to have suffered a mild brain injury and is seeking damages from the restaurant.

Jody L. Danielson filed a lawsuit on Jan. 21 in Pleasants Circuit Court against Nadine Theiman and Pizza Station, claiming he sustained injuries while visiting the restaurant.

Danielson asserts that on Jan. 21, 2014, he went to the Pizza Station at 206 Lafayette St. in St. Marys and slipped on ice after getting out of his daughter's truck, allegedly striking his head on the running board of the truck. The plaintiff claims that the area around the entrance has low spots in which water drains to a manhole. Danielson claims the water in this area had frozen over and caused his fall. The lighting around the area was also very dark, causing a hazard, according to the suit.

Danielson claims to have been diagnosed with a mild brain injury and PTSD.

He is suing for $150,000 for compensatory damages, and $150,000 for pain and suffering. He chose not to be represented by any attorney. Judge Timothy Sweeney is presiding over the case.
