Nursing home sued after death of resident

HUNTINGTON — A Cabell County man is suing a nursing home, Huntington Health and Rehab Center, in a case involving his grandfather’s care.

Charles Thomas, personal representative of the estate of Carl Thomas, filed a lawsuit Feb. 1 in Cabell Circuit Court against Seventeenth Street Associates LLC (doing business as Huntington Health and Rehabilitation Center), SavaSeniorcare Administrative Services LLC, SavaSeniorcare Consulting LLC and administrator Annica Stansberry, alleging negligence.

 

According to the complaint, Carl Thomas experienced systemic abuse and neglect while a resident of Huntington, suffering skin breakdown, multiple falls, physical injuries, mental anguish, physical pain and suffering and deprivation and/or delay of appropriate treatment. The suit says his significant injuries contributed to his May 12, 2014 death.

Charles Thomas seeks a jury trial, punitive damages in an amount to be proven at trial, plus litigation costs. He is represented by attorney Andrew L. Paternostro and Jeff D. Stewart of The Bell Law Firm PLLC in Charleston.

Judge Christopher M. Chiles has been assigned to the case.
