Woman sues bank over alleged collection methods

WINFIELD — A West Virginia woman alleges her bank attempted to collect an unpaid debt through harassing telephone calls and written communication that violated the state’s Consumer Credit and Protection Act.

Sandra Ross filed a lawsuit Feb. 10 in Putnam Circuit Court against JPMorgan Chase Bank, N.A., alleging invasion of privacy, infliction of emotional distress, negligence and telephone harassment.

According to the complaint, JPMorgan Chase Bank placed numerous, repeated harassing phone calls and made other electronic communications to Ross at unusual or inconvenient times, in spite of her requests not to do so. The plaintiff alleges common-law invasion of privacy, intentional infliction of emotional distress, common-law negligence, and violation of state telephone-harassment, computer-crimes and consumer-credit laws. The suit also claims Chase failed to adequately train or supervise their employees to ensure compliance with state debt collection laws.

Ross seeks a jury trial and punitive and compensatory damages, plus legal fees, in an amount less than $75,000. She is represented by attorney Benjamin M. Sheridan and Daniel K. Armstrong of Klein & Sheridan L.C. in Hurricane, West Virginia.

Judge Joseph Reeder is assigned to the case.
