HUNTINGTON — A Cabell County man says he was permanently injured from a fall due to a sharp railing edge on the rear steps of his apartment building.
Ralph Wilburn filed a lawsuit Feb. 16 in Cabell Circuit Court against Ohio Valley Development Corp. and an unnamed defendant working for Ohio Valley, alleging personal injury liability.
According to the complaint, on May 6, 2014, Wilburn was ascending the iron steps at the rear of his building on 18th Street in West Huntington when his clothing was caught in a sharp, protruding edge of the stair railing. Wilburn claims his fall caused serious and ongoing injuries, mental anguish, and lost wages and earning capacity, allegedly due to the defendant’s negligence. The unnamed defendant John Doe(s) is accused of failing to inspect the premises for safety.
Wilburn seeks a jury trial and compensatory damages, plus interest and litigation costs. He is represented by attorneys James A. Villanova and Michael E. Metro of Villanova Law Offices in Pittsburgh.
Judge F. Jane Hustead is assigned to the case.
