Property owners accuse CSX of denying access to their land

POINT PLEASANT – Two Mason County property owners are suing CSX in a dispute over land access.

William Douglas Brown and Brenda Harriet Brown filed a lawsuit on Feb. 26 in Mason Circuit Court against CSX Transportation Inc. and three unnamed defendants.

According to the complaint, the Browns won a civil judgment giving them access to land in Henderson based on an 1887 deed requiring the predecessor of CSX to provide railroad crossings on the property. The Browns claim, however, that CSX is violating the previous court judgment by refusing to provide additional access crossings. Without additional crossings, the suit says the property remains landlocked and valueless.

The Browns seek a declaratory judgment determining whether they are entitled to access the land, and if additional crossings are unsafe, a determination of an alternative method of access. They are represented by attorney Robert W. Bright of Middleport, Ohio.
