Plateau Medical Center accuses Mountain Medical Associates of contract breach

FAYETTEVILLE – Plateau Medical Center is suing Mountain Medical Associates after the hospital claims the medical practice breached its contract.

Oak Hill Hospital Corporation is doing business as Plateau Medical Center. Scott Keffer Inc. is doing business as Mountain Medical Associates.

On Oct. 12, 2011, Dr. Mary K. Coll, Plateau and Mountain entered into a salary subsidy recruitment agreement that was for a period of Oct. 24, 2011, until Oct. 23, 2014.

The plaintiff claims Coll breached the agreement and Plateau made three written demands to Mountain to repay the unforgiven amount of the salary subsidy payments.

Despite the hospital’s written demands for repayment, Mountain has not paid any of the amount owed and failed to pay $99,750, which constitutes a material breach of the agreement, according to the suit.

Plateau claims Mountain was unjustly enriched at Plateau’s expense.

Plateau is seeking compensatory damages with pre- and post-judgment interest. It is being represented by Sam Fox and Caleb Knight of Flaherty Sensabaugh Bonasso PLLC.

The case is assigned to Circuit Judge Paul M. Blake Jr.
