WEST UNION — A Doddridge County couple say their insurance carrier is refusing to pay for water damage to their home.
Lewis J. and Helen Swann filed a lawsuit March 3 in Doddridge Circuit Court against State Farm Fire and Casualty Co., alleging breach of contract and violations of the Unfair Trade Practice Act.
According to the complaint, the Swann’s home and personal property were damaged by water infiltration and backup in their basement on April 10, 2015. However, the suit says State Farm has used delay tactics, refused to investigate the claim and relied on questionable policy exclusions, allegedly in an attempt to refuse payment.
The plaintiffs seek a jury trial and punitive and compensatory damages of less than $75,000. They are represented by attorney Todd Wiseman of the Wiseman Law Firm PLLC in Vienna.
Judge Timothy L. Sweeney is assigned to the case.
