Fired worker accuses Monitronics of wrongful termination

BECKLEY – A Raleigh County man is suing his ex-employer for allegedly firing him over a workers' compensation claim.

David Barker filed a lawsuit Feb. 23 in Raleigh Circuit Court against Monitronics Security LP, doing business as Monitronics International Inc., alleging retaliatory termination.

According to the complaint, Barker began working for Monitronics after the company acquired his former employer, absorbing Barker’s workers' compensation claim. Barker says he was injured on the job on Nov. 12, 2013, and still suffers impairments from the incident.

The suit says Monitronics terminated Barker on Oct. 27, 2015, after denying continuance of his claim from two years ago, claiming his position had been eliminated. At the time, Barker claims he was still receiving treatment and disability benefits, alleging that was the reason behind his dismissal.

Barker seeks a jury trial and damages for lost wages and benefits, future medical coverage and emotional distress, plus litigation costs. He is represented by attorney Jason R. Grubbs of Beaver. The case has been assigned to Circuit Judge Robert A. Burnside Jr.
