Doctor blames software firm for alleged insurance difficulties

BECKLEY – A Raleigh County doctor says the proprietary software a Kentucky firm sold her allegedly generated coding errors, causing insurers to falsely accuse her of overcharging.

Dr. Rhonda Guy and her practice, Dr. Rhonda Guy and Associates PLLC filed a lawsuit Feb. 12 in Raleigh Circuit Court against Ulrich Medical Concepts Inc., alleging breach of contract, breach of express and implied warranty, and negligence.

According to the complaint, the parties entered a contract during the summer of 2007 whereby Guy leased computer hardware and software for her medical practice. Although Ulrich claimed its proprietary software would properly code procedures, Guy says a third-party audit revealed coding errors that caused an insurance company to demand repayment for services it had already covered.

Guy seeks a jury trial and compensatory damages, as well as litigation costs and interest. She is represented by attorney R. Dean Hartley, Mark R. Staun and David B. Lunsford of Hartley & O’Brien PLLC in Wheeling.

Judge Robert A. Burnside Jr. is assigned to the case.
