WINFIELD — A Putnam County couple had sued a firm they hired to remodel their kitchen, claiming the workers lied about the project’s cost. But the case eventually was dismissed
B. Lane Jividen and Mary J. Jividen filed a lawsuit March 11 in Putnam Circuit Court against Gregory and Stephanie Anderson, and Anderson’s Handyman Services LLC, alleging fraud, conversion and unjust enrichment. It was dismissed April 27, according to court documents.
According to the complaint, the plaintiffs hired Anderson’s Handyman Services to perform a $15,000 remodel of their home, including new kitchen cabinets and appliances. The suit says the Andersons assured the plaintiffs they could complete all the work for the contracted price, and requested a $7,500 down payment.
During a meeting to select new cabinets, the Jividens discovered the cabinets alone would cost $15,000, and allegedly discovered that the Andersons had underbid the project with what the plaintiffs claim was the intention of fording the plaintiffs to pay more than twice the original bid. As a result, the Jividens claim, they canceled the contract and are suing for a refund of the down payment.
The Jividens sought damages of $7,500 plus interest and litigation fees. They were represented by attorney H.F. Salsbery of Bailey & Wyant PLLC in Charleston.
