Injured customer accuses car dealership of negligence

CHARLESTON — A Kanawha County man says he was injured during a slip-and-fall accident on an icy patch in an automobile dealer’s parking lot.

Joseph Badgley filed a lawsuit Feb. 17 in Kanawha Circuit Court against Love Imports of St. Albans Inc., alleging personal injury liability.

According to the complaint, on Feb. 18, 2014, Badgley was a customer of Love Imports when he slipped on ice while walking on the defendant’s premises. The suit says Love Imports neglected its duty to provide safe walkways for customers, causing the plaintiff to suffer mental and physical injuries and incur medical expenses.

Badgley seeks a jury trial and compensatory damages. He is represented by attorney Thomas H. Peyton of the Peyton Law Firm PLLC in Nitro.

Judge Joanna Tabit is assigned to the case.
