Residents blame nearby refinery for pollution, noise

MOUNDSVILLE – A group of Marshall County residents say an oil and gas refinery near their neighborhood has created a public nuisance.

Richard E. Vargo, Jade L. Goodnight, Todd Kettler, Dawn Kettler, Harley L. Gatts II and Patricia Gatts filed a lawsuit March 10 in Marshall Circuit Court against Williams Ohio Valley Midstream LLC, alleging negligence and reckless conduct.

According to the complaint, since Williams built its Oak Grove facility off of Fork Ridge Road in Marshall County, the plaintiffs have battled foul odors, dust, dirt and debris emitted from the plant. The suit also claims bright light and noise from the refinery have diminished their enjoyment and use of their property.

The plaintiffs seek a jury trial, an injunction to stop the defendant’s facility from operating, and compensatory damages. They are represented by attorneys Eric M. Gordon of Berry, Kessler, Crutchfield, Taylor & Gordon in Moundsville and Robert J. Fitzsimmons of Fitzsimmons Law Firm PLLC in Wheeling.
