Couple accuse driver of negligence over car wreck

CHARLESTON – A Kanawha County couple is suing an alleged reckless driver who they claim caused an accident involving their vehicle.

David and Janet Bragg filed a lawsuit Feb. 25 in Kanawha Circuit Court against Chelsea Brean Centers, the woman allegedly driving the other vehicle, and C&O Motors.

According to the complaint, C&O Motors lent Centers a vehicle for business use on Feb. 28, 2014. The suit says Centers negligently operated the vehicle, striking the plaintiffs’ car as it was lawfully stopped in traffic. As a result of the incident, the suit claims, David Bragg suffered property damage and physical injury, whereas his wife, Janet, suffered loss of consortium. The complaint says the plaintiffs have already received a partial settlement from the defendants’ insurance carrier.

The Braggs seek compensation for physical and property damages, medical costs, lost wages, permanent disability, and litigation costs. They are represented by attorney Richard J. Lindroth of Eleanor.

Judge Louis H. “Duke” Bloom is assigned to the case.
