MORGANTOWN – A lawsuit claims understaffing and other issues at an area nursing home allegedly allowed a woman to suffer injuries and neglect.

Sheila Smith and Patricia Rainwater, as power of attorney for Alicia Kavanagh, filed a lawsuit Feb. 18 in Monongalia Circuit Court against RWNR LLC (doing business as Worthington Nursing and Rehabilitation Center), Charlene Kimberly and Deanna Cramer, alleging negligence and reckless misconduct.

According to the complaint, the defendant neglected Kavanagh’s care while she was a resident of the facility, failing to provide basic needs such as food, water, cleaning and assistance with activities, as well as security for the nursing home. The alleged pattern of neglect allowed Kavanagh to suffer numerous falls, the suit claims, resulting in a leg fracture and significant deterioration of her overall physical and mental condition.

The plaintiffs seek a jury trial, punitive and compensatory damages, and reimbursement for litigation expenses. They are represented by attorneys Andrew L. Paternostro and Jeff D. Stewart of The Bell Law Firm PLLC in Charleston.
