Cell phone customer accuses telemarketer of alleged harassment

CHARLESTON – A Kanawha County man is suing a telemarketer for allegedly placing numerous harassing calls to his cell phone for no apparent reason.

Gordon Lane Jr. filed a lawsuit March 9 in Kanawha Circuit Court against ADS Media Marketing, doing business as Supernova, alleging violations of the West Virginia Consumer Credit and Protection Act and the Computer Crime and Abuse Act.

According to the complaint, although Lane and the defendant have no prior business relationship, ADS Media Marketing began placing automated calls to his cell number in June of 2015. The suit says the calls, which began with a hesitation followed by a recorded script, persisted despite Lane’s number having been listed on the National Do Not Call Registry since Sept. 5, 2009. The plaintiff claims ADS would spoof his number, making Caller ID show that the number calling was his own.

Lane seeks punitive and compensatory damages and a restraining order halting further alleged harassment from ADS. He is represented by attorney Charles R. Pinkerton of Pinkerton Law Practice in Morgantown.
