Driller accuses mine of contract breach

PRINCETON – A Virginia company is suing a West Virginia coal mine for allegedly failing to pay for services.

Gasco Drilling Inc. filed a lawsuit April 4 in Mercer Circuit Court against Pinnacle Mining Company LLC, alleging breach of contract.

According to the complaint, the parties entered into a contract on June 18, 2012 whereby Gasco would provide drilling of degasification boreholes at the mine. Although Gasco claims it performed the work, Pinnacle has yet to pay an invoice issued Nov. 5 for $129,203, the suit says.

Gasco seeks recovery of the entire unpaid amount, plus interest and attorney’s fees. It is represented by attorney David M. Kersey of the law firm of Brewster, Morhous, Cameron, Caruth, Moore, Kersey & Stafford PLLC in Bluefield.

Judge Derek C. Swope is assigned to the case.
