MOUNDSVILLE – A Pennsylvania company is suing a firm in Marshall County in an attempt to compel its testimony in a separate case.
Kahle’s Kitchens Inc. filed a lawsuit in Marshall Circuit Court against Shutler Cabinets Inc.
According to the complaint, Kahle’s Kitchens believes Shutler Cabinets has information, knowledge and documents relevant to Kahle's dispute with Distributor Services Inc. in a case filed in Clarion County, Pennsylvania. The suit says West Virginia state law requires a foreign court order to be filed in the county where the defendant resides.
The plaintiff seeks a subpoena to force Shutler to give a deposition and supply relevant documents. It is represented by attorney Matthew G. Chapman of Burns White LLC in Wheeling.
