Engineering firm officers accused of not paying for products

WINFIELD — Materials supplier is suing Jennifer Fox Casey and John Casey, engineering firm officers, citing alleged breach of contract and failure to pay delivered products.

Foster Supply Inc. filed a complaint on June 10 in Putnam Circuit Court against the defendants, alleging that they failed to comply with the terms of their promissory note.

According to the complaint, the plaintiff alleges that despite repeated attempts to collect payment, it has not received payment for materials sold to Fox Engineering Inc. The plaintiff holds Jennifer Fox Casey and John Casey responsible because the defendants allegedly failed and refused to pay the balance due and owing under the terms of the promissory note.

The plaintiff requests a trial by jury and seeks judgment against the defendants in the amount of $30,214.51, plus interest accruing from June 8 to the date of judgment, attorney's fees and costs and such other and further relief as it may deem just and proper. It is represented by Richard M. Francis of Bowles Rice LLP in Charleston.
