Swanson Industries files two lawsuits to recover more than $25,000

BECKLEY – Swanson Industries has filed two lawsuits against companies it claims owes more than $25,000 for goods.

Southern Mine Service LLC and Beckley Drilling & Blasting Services Inc. were named as defendants in the suits

At the defendants’ request, Swanson sold them certain goods and the defendants failed to pay for those goods, according to two complaints filed June 14 in Raleigh Circuit Court.

Swanson claims the defendants received and accepted the goods and then failed and refused to pay for them in the amount of $6,207 and $19,120.44, for a combined total of $25,327.44.

The defendants’ actions were a breach of contract and caused Swanson damages, according to the suits.

Swanson claims the defendants have been unjustly enriched at Swanson’s expense.

Allowing the defendants to retain the benefit of the goods without paying fair compensation would be unjust, according to the suits.

Swanson is seeking judgment in the amounts of $6,207 and $19,120.44. It is being represented by John R. Keating of Amato Keating & Lessa.
