MORGANTOWN — A woman is suing Aarsand Management LLC d/b/a Taco Bell, a fast food chain, citing alleged negligence, failure to warn and insufficient measures taken to prevent injuries.

Brenda Frazier filed a complaint on June 20 in Monongalia Circuit Court against Aarsand Management LLC d/b/a Taco Bell, alleging that the fast food chain failed to maintain its premises in a safe and reasonable condition.

According to the complaint, the plaintiff alleges that on Sept. 21, 2014, she fell to the asphalt-covered ground on the defendant's premises when her foot caught the non-tapered edge of a ramp, causing her to suffer serious injuries, including but not limited to a fractured right wrist and compression of the median nerve in the right wrist. The plaintiff holds the defendant responsible because the defendant allegedly constructed the concrete ramp into the parking lot without a flared side, failed to place warning signs on non-tapered edges and failed to take necessary precautions to alert the public of the trip hazard.

The plaintiff requests a trial by jury and seeks judgment for compensatory damages that include her personal injuries and medical expenses in an amount that will fully and fairly compensate her. She is represented by William Flanigan of Sanders, Austin & Flanigan in Princeton.
