Driver, insurer sued after truck allegedly goes off road and causes damage

BECKLEY — Four vehicle owners, one of whom is a property owner, are suing Charles D. Thompson and Hartford Insurance Company of the Midwest, a truck operator and his insurer, alleging insufficient measures taken to prevent damages and failure to pay claims.

Margaret Jones, Jackie Bolen, Ronnie White (who also owns real estate and a building) and Ronnie Rutledge filed a complaint on June 30 in Raleigh Circuit Court against the defendants, alleging that Thompson operated a 2015 GMC Sierra pickup truck negligently and carelessly.

According to the complaint, the plaintiffs allege that on March 16, they suffered damage to vehicles and property when Thompson's vehicle ran off the road, causing them to suffer losses they claim have not been covered by the insurer. They hold the defendants responsible for Thompson's alleged careless driving and the insurer's failure to pay, plus the insurer's alleged improper taking of two of the damaged vehicles.

The plaintiffs request a trial by jury and seek an award for damages against the defendants for loss of use of their vehicles in an amount of $50 per day, attorney's fees and court costs. They are represented by Benny G. Jones of Benny Jones Law Office in Beckley.
