BECKLEY – A Shady Spring couple alleges a Jeep they purchased had several problems and that the manufacturer did not correctly repair it.
April and David Treadway filed a complaint on July 14 in the Raleigh Circuit Court against FCA US LLC alleging that the manufacturer breached its obligation under the West Virginia Code.
According to the complaint, the plaintiffs allege that on Sept. 21, 2015, they purchased a new 2015 Jeep Renegade from an authorized dealer. After the purchase, they claim they experienced nonconformities with the vehicle's warranty, which substantially impaired its use and market value, causing them to suffer annoyance, inconvenience and out-of-pocket expenses.
The plaintiffs hold FCA US LLC responsible because the defendant allegedly failed to conform the vehicle to the warranty or replace it with a new comparable unit.
The plaintiffs request a trial by jury and seek revocation of acceptance and a refund, costs of repairs, damages, attorney's fees and such other relief as the court shall deem appropriate. They are represented by Anthony M. Salvatore of Hewitt & Salvatore PLLC in Beckley. The case has been assigned to Circuit Judge John A. Hutchison.
