Man seeks compensation for injuries from fall

WINFIELD — A former asbestos removal worker from Ohio is suing Thermal Solutions Inc., Eaves Recycling Inc. and Structures Resources Inc., citing alleged negligence and insufficient measures taken to prevent injuries.

Derrick George filed a complaint on July 14 in Putnam Circuit Court against the defendants for various allegations, including failure to comply with workers' compensation insurance law in West Virginia, negligence, joint venture liability and failure to provide a safe workplace.

According to the complaint, the plaintiff alleges that on Oct. 25, 2012, he was acting under the explicit orders of his employer, Thermal Solutions, when he fell through the roof structure of the building owned by defendant Structures Resources, due to activities of defendant Eaves Recycling, causing him to sustain injuries to his abdomen, back and lower extremities and suffer damages for medical expenses, lost wages, mental anguish and loss of capacity to enjoy life. The plaintiff holds the defendants responsible for various alleged roles in the case.

The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages in an amount above the jurisdictional minimum limit of the court. He is represented by Matthew L. Clark of Kayser Layne & Clark PLLC in Point Pleasant.
