LOGAN — An administrator of a deceased woman's estate is suing Logan General Hospital, alleging negligence and insufficient insufficient measures taken to prevent injuries in connection with a fall from a portable commode.
Brenda Bryant, administratrix of the estate of Irene Whitt, filed a complaint on Aug. 16 in Logan Circuit Court against Logan General Hospital, alleging that the hospital operator deviated from the standard duty of care.
According to the complaint, the plaintiff alleges that on Aug. 20, 2014, Whitt was a patient at the defendant's facility. While awaiting admittance, she was assisted by a nurse to a bedside commode that lacked rubber tips on the legs and slid out from under Whitt, causing her to hit the ground and fracture her hip, which required a surgical procedure that then led to an infection that is purported to be the proximate cause of Whitt's death. The plaintiff holds Logan General Hospital responsible because the defendant allegedly negligently allowed a defective portable commode to be in use at its facility.
The plaintiff requests a trial by jury and seeks judgment against the defendant in such amount that will reasonably compensate the estate of decedent Whitt for damages, pre- and post-judgment interest, costs of this action and such other relief as the court deems proper.
